Oscar is unethical and does not play fair. I was on the buyer side for a property he was selling in Coral Gables for an elderly lady who is a family friend. I have no realtor so Oscar was representing both buyer and seller in this transaction.

The house was not on the market and after a week of chasing him down, he showed me the house on a Friday morning. Immediately after the showing, I told him I wanted to offer asking price but he told me he was going out of town immediately after the showing so I had to wait until he was back on Monday.

Monday comes, I reach out to Oscar in the morning but don't get in contact with him until around 12p. In our conversation, he suddenly tells me he has another offer. I submit my offer of asking price hoping he would have my best interest at heart and let me counteroffer if the other offer was larger and on Tuesday he emails me "Your offer has not been accepted. Thank you much". No chance at a counter.

After speaking to the seller and her family, I have confirmed that Oscar DID NOT provide the owner of the house with a hard copy or email about my offer until AFTER the other offer was accepted. Additionally, I come to find out from the seller that one of the "family friends" legally involved in the sale is a realtor who referred Oscar to the seller. Oscar NEVER disclosed this to me. I was also told by the family that the "family friend" is a realtor who made some sort of commission on the sale. So the way I see it, Oscar clearly pushed the larger deal to make more money for himself without ever disclosing the other offer he had to me until he legally had to - the day I made my offer.

Representing me in this deal, Oscar should of had my best interest in mind and he clearly did not. Both I and the seller are displeased with his ethics and feel like we both could have been better represented. Oscar clearly had personal interest in this deal and it effected his willingness to have his seller evaluate all their options/offers. When your seller agrees that you have questionable ethics, that's not a good thing. Steer clear of Oscar if you are selling or buying a home...especially if there are people involved who can easily be taken advantage of. I will be filing a formal complaint with FREC and I have the full support of the seller's family. That should tell you all you need to know about this guy!
